Right to Nominate

The right to nominate another individual to exercise the Data Principal’s rights in the event of death or incapacity.

Section 14

What it means

Section 14 allows a Data Principal to nominate another individual who shall, in the event of death or incapacity of the Data Principal, exercise the Data Principal’s rights in accordance with the Act. Nomination is rights continuity — not a general commercial power of attorney for all matters.

Worked example

A Principal nominates their sibling to exercise access and erasure rights if they become incapacitated. When that event occurs, the Fiduciary needs a way to recognise the nominee and authenticate the situation — not treat every relative caller as automatically nominated.

In practice

Provide a way to record nominees, store the nomination, and verify nominees when rights must be exercised. Keep nomination distinct from lawful-guardian flows for children or Rule 11 guardianship.
